The state Alpha had imposed an embargo on imports of tuna caught by fishing methods that endangered dolphins. Alpha adopted the national law which prohibits the usage of such fishing techniques. At the same time, Alpha has a preferential trade agreement with the state Beta, which allows imports of fish products without any restrictions.
States Gamma, Delta and Epsilon complained to the WTO that this embargo violated Article XI of the GATT.
